1. Introduction

Welcome to Breakfast NZ ("breakfast.co.nz", "the Site", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms of Use. If you do not agree, please do not use the Site.

Breakfast NZ publishes recipes, smoothie tools, the Breakfast DNA Quiz, articles, and a weekly newsletter for people who want better mornings. These terms cover all features and services available on the Site, including future paid subscription tiers when introduced.

2. Eligibility

You must be at least 16 years of age to create an account or subscribe to the newsletter. By creating an account or subscribing, you represent that you meet this requirement. The Site is not directed at children.

3. Accounts and Registration

Some features require a registered account. When you create an account, you agree to:

• Provide accurate and complete information
• Keep your login credentials secure and confidential
• Notify us promptly if you suspect unauthorised access to your account
• Accept responsibility for all activity that occurs under your account

You may sign up using an email address and password, or through a supported social login provider (Google, Facebook, Apple, LinkedIn, or GitHub). When using social login, we receive basic profile information from the provider in accordance with their privacy policies.

We also offer a "newsletter-only" sign-up that does not require a password. Newsletter-only subscribers receive marketing emails but cannot access account-gated features (such as saving recipes or commenting). You may upgrade a newsletter-only subscription to a full account at any time.

4. Newsletter Subscription

You may subscribe to the Breakfast NZ newsletter through any of the sign-up forms on the Site (including the homepage, the Breakfast DNA Quiz, and individual recipe pages). When you subscribe:

• We send you a confirmation email and require you to confirm your subscription before any further emails are sent (double opt-in).
• Once confirmed, we send a weekly newsletter with recipes, articles, and seasonal tips. You may also receive occasional welcome and onboarding emails.
• Every email contains a one-click unsubscribe link. You can also manage your preferences using the link in the email footer.
• If you took the Breakfast DNA Quiz, your assigned persona may be used to tailor newsletter content to your preferences.

The newsletter is provided free of charge and we may pause, change, or discontinue it at any time.

5. Breakfast DNA Quiz

The Breakfast DNA Quiz matches your answers to one of twelve breakfast personas. The persona is a playful editorial categorisation, not a clinical or nutritional assessment. Persona assignments and the recipes recommended on the basis of them are for entertainment and convenience only.

If you provide your email address at the end of the quiz, you may also choose to subscribe to the newsletter. The quiz works without subscribing — you can always view your result on its share page.

6. Recipes, Smoothies, and Editorial Content

Recipes, smoothie templates, articles, and editorial photography on the Site are owned by Breakfast NZ or licensed to us. You may:

• Cook recipes for personal, non-commercial use
• Share recipe links with friends and on social media
• Print recipes for personal kitchen use

You may not:

• Reproduce recipe text, photography, or articles on another website, blog, app, cookbook, or commercial publication without our written permission
• Scrape, crawl, or systematically extract content from the Site
• Train machine-learning models on our content without our written permission

Recipes are provided for general guidance. Cooking times, ingredient availability, and nutritional content vary. Always check ingredients for allergens that affect you and use safe food-handling practices.

7. Comments and User-Submitted Content

Account holders may post comments on recipes and articles. By posting a comment you agree that:

• The comment is your own work or you have permission to post it
• You grant Breakfast NZ a non-exclusive, royalty-free, worldwide licence to display, edit, and quote the comment in connection with the Site and our marketing
• You will not post unlawful, abusive, defamatory, spam, or commercially promotional content
• We may edit, remove, or refuse to publish comments at our discretion

8. Shopping Lists by Email

You can request a shopping list to be emailed to you from any recipe page. The email address you provide is used only to send that single shopping list and is not added to any marketing list unless you separately subscribe to the newsletter.

9. Subscriptions and Payments (future)

We may introduce paid subscription tiers that unlock additional features. When paid subscriptions are introduced, the following terms will apply:

• Payment processing will be handled by Stripe, our payment processor
• You will agree to Stripe's terms of service for payment processing
• Subscriptions will renew automatically at the end of each billing period unless cancelled
• You will be able to cancel your subscription at any time through your account dashboard, with cancellation taking effect at the end of the current billing period
• We will not offer refunds for partial billing periods unless required by law

Subscription pricing, features, and terms will be displayed clearly at the point of purchase before you are charged. Until paid subscriptions are introduced, all features on the Site are free.

10. Advertising

We display advertisements on the Site through Google AdSense. Ads may be personalised based on your browsing history and may use cookies set by Google or its advertising partners. You can manage personalised advertising settings through Google's Ads Settings.

11. Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose
• Scrape, crawl, or systematically extract content from the Site
• Submit false, misleading, or spam content (including in comments and quiz answers)
• Attempt to circumvent rate limits, access controls, or security measures
• Interfere with the operation of the Site or other users' access
• Use the Site to harass, defame, or infringe on others' rights
• Create multiple accounts to circumvent usage limits or post abusive content
• Sign up to the newsletter using an email address that is not yours

We reserve the right to suspend or terminate accounts and remove subscribers that violate these terms.

12. Intellectual Property

All content on the Site — including text, recipes, photography, illustrations, logos, the Breakfast DNA persona names and descriptions, and software — is owned by Breakfast NZ or its licensors and is protected by copyright and other intellectual property laws.

Comments and other content you submit remain your own, but you grant us the licence described in section 7 to display them on the Site.

13. Third-Party Links and Services

The Site may link to external websites, recipes hosted elsewhere, or affiliate retailers. We are not responsible for the content, accuracy, or privacy practices of third-party sites. Following an external link is at your own risk.

14. Limitation of Liability

The Site and its services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by New Zealand law, Breakfast NZ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including but not limited to damages relating to following recipes, allergic reactions, food safety, persona assignments, or loss of data.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under New Zealand law, including the Consumer Guarantees Act 1993.

15. Changes to These Terms

We may update these Terms of Use from time to time. Material changes will be communicated via email to registered users and newsletter subscribers, and the updated terms will be posted on the Site with a new effective date. Continued use of the Site or continued newsletter subscription after changes take effect constitutes acceptance of the updated terms.

16. Termination

You may stop using the Site or unsubscribe from the newsletter at any time. We may suspend or terminate your access to the Site or remove you from the newsletter if you breach these terms or if we discontinue the Site.

17. Governing Law

These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
